Basic Regulations
These General Trade Terms apply between the Provider and the Client which is using the services of the Provider.
The scope of services of the corresponding event can be found in the advertised program and the booking confirmation. With the commissioning of the Provider , these General Terms and Conditions are deemed to have been accepted; deviating terms and conditions of the customer that conflict with these General Terms and Conditions will not be recognized unless their validity is expressly agreed to in a written form by the Provider.
Booking
The Client can book the services of the Provider through Email or the Website Contact Form. Through confirmation in a written form (Email) of the booking by Norikarocks and the transfer of deposit to the Provider`s bank account, the booking becomes valid and a contract is formed. When booking an Event, 50% of the total price is due right away to confirm the booking. The full amount is due without deduction up to 14 days before the start of the course. Payment must be made exclusively by bank transfer to the account specified on the invoice.
Liability Waiver
The Provider is obliged to inform the Clients that the services are not suitable for kids until eight years of age, people with heart condition, people with epilepsy, people with high blood pressure, people with fear of heights and people with similar health conditions. Clients are participating at their own risk and responsibility. The Provider pledges to give the Clients specific training in technique, security, equipment and other conditions connected with provided services. The Provider is responsible for inspecting the equipment to be used.
The Provider is not responsible for the equipment not provided to the Clients by himself. This includes the equipment the Clients borrowed elsewhere or their own equipment etc.
The Provider has no liability in case the Client conceals or does not provide information about his/her health conditions and complications that could cause injury or death.
Wearing of the helmet is recommended during the whole time of the action (the outdoor activities) with no exception. Not complying with this recommendation is at the Client’s own risk.
The Provider has no liability for Clients that decide not to obey the instructions given by the Provider or his staff. The Provider has no liability for Clients acting in a dangerous or harmful way either to themselves or to the others.
The Provider has no liability for private and independent activities not arranged and provided by the Provider. The Provider does not arrange health and travel insurance and has no liability for any medical and other expenses and problems arising from not suitable travel or climbing insurance.
The Provider strongly recommends to arrange insurance for climbers.
The Clients give up the possibility to press charges against the Provider, his staff, and other people acting in the Provider’s name, regarding real or consequent damage of any sort, known or unknown, expected and unexpected, resulting from or connected in any way with the provided services and the Clients’ participation in the services.
All the claims and litigations arising from these trade terms and conditions and during the activities abide by the Austrian legal system and will be arbitrated by Austrian court with territorial jurisdiction.
The Provider is not accountable in any way for the weather during the planned activity. In case of bad or not suitable weather, the Provider can cancel, postpone or re-plan the activity. In case the activity is cancelled, the Provider can claim the reimbursement of the expenditures spent while organizing the activity.
The Provider shall not be liable for anything that may happen because of force majeure, which includes, but is not limited to natural cataclysms, war or military operations, breakdowns of the mechanical facilities, fire, vehicles or electrical appliances, civil disturbances, labor strikes, actions of the government authorities, political unrest, insurrections and mutinies, extreme weather conditions and other calamities and situations beyond the Providers reasonable control and which they could not foresee.
Responsibilities of the Provider
The Provider is responsible for all the material and equipment he/she lends or provides to the Clients for the activity (excluding manufacturing defects).
The Provider is responsible for all the instructing provided by his guides/instructors during the whole action.
In the case of an accident, the Provider provides adequate assistance.
Health Complications
In case of health complications, the Provider has a first aid kit and if needed emergency medical services can be called. If the Client doesn’t feel good during the activity due to an asthma attack or fear of heights, he/she can ask the staff to terminate the activity. The Provider has the right to terminate the activity at any time he/she considers it appropriate. If the Client suffers from any above mentioned health conditions and participates in the activities regardless, the Provider is not liable for any health complications or financial loss arising from those.
It is in the Clients own responsibility to determine whether they are physically fit for the courses and assess your health conditions. Upon Clients request, the Provider may advise them on this matter. At the same time, Provider recommends seeking a qualified medical opinion if the Client is not sure.
Images and Marketing
The Provider may take photos, videos, and other media images during the tours. These photos and videos may have the Clients image. By taking part in these courses, the Client agrees that the Provider may use this media material for marketing, promotion, and advertising without any royalty and other payments. The Client may inform the Provider if they do not want their image to be captured with any photo or video cameras.
Return Policy
Cancellation by the participant is possible at any time. The cancellation must be sent exclusively by e-mail to [email protected], stating the full name and the booked event including the date of the event.
For Events in Austria: There are no cancellation fees up to 14 days before the start of the event. From the 13th to the 7th day before the start of the event: 50% of the total price.
From the 6th day before the start of the event: 100% of the total price In the event of a postponement or cancellation of an event, any costs and expenses incurred by the customer himself, e.g. transport or accommodation costs, will not be reimbursed. If the client does not show up at the event or does not arrive on time, there is no right to a refund.
For Events abroad: There are no cancellation fees up to 30 days before the start of the event. From the 29th to the 16th day before the start of the event: 50% of the total price.
From the 15th day before the start of the event: 100% of the total price In the event of a postponement or cancellation of an event, any costs and expenses incurred by the customer himself, e.g. transport or accommodation costs, will not be reimbursed. If the client does not show up at the event or does not arrive on time, there is no right to a refund.
In case of a sudden and unexpected incident (e.g. injury, sickness ) the payment can be transferred to another activity/action of the Provider that takes place within six months from the date of the initial activity/action.
Covid-19 If the entry regulations for events abroad change between the time of booking and the start of the trip in such a way that entry into the destination country or return journey to the home country is no longer possible, the Provider must be informed immediately. In this case the Provider will refund the amount paid in full.
